Can I Sell AI Art? Etsy, Redbubble and the Legal Basics

Yes, you can sell AI art in the US. Etsy allows AI-generated art made from your own prompts as long as the listing description says AI was used, and Redbubble accepts uploads that are your original creations and don't infringe anyone's rights. Leave out characters, logos and real people, and know that a purely AI-made image usually can't be copyrighted, so copycats can be hard to stop.

You can sell AI art, and the big marketplaces allow it with conditions. Etsy lists art generated from a seller's own prompts as an allowed category if the listing says AI was used. Redbubble's rules apply to AI art the same way they apply to any upload, and Amazon's book platform asks you to declare AI images. The risks come from copying other people's work and from copyright's human-authorship rule. Treat this as a summary of US law and marketplace rules, not legal advice.

Where you can sell AI art

Each marketplace sets its own rules, and the two that matter most are whether it allows AI art and what it makes you disclose. As of September 2026:

You can also sell images created with AI outside these sites, through your own shop or directly to clients. Then the AI tool's terms are the platform rules that apply. OpenAI's Terms of Use give you ownership of ChatGPT output where the law permits, and they forbid presenting that output as human-made. Midjourney requires companies with revenue above $1,000,000 a year, and their staff, to be on its Pro or Mega plan before they own their images. Midjourney also makes your images public by default, where others can view and remix them, which matters before you sell a design as your own.

In general, yes. Etsy and Amazon's KDP allow AI art outright, Redbubble applies its usual rules, and all three leave the checks to you. Redbubble makes sellers promise their content doesn't infringe copyright, trademark, privacy or publicity rights, and Etsy's AI policy bans content that violates other people's privacy or publicity rights. Before you list a piece, check three things:

  • Copying. In its AI training report, the Copyright Office points out that AI systems have turned out copyrightable characters and near-copies of movie stills, and it calls such outputs likely infringement. A character, a logo or a famous painting is a no, however the image was made.
  • People. Etsy and Redbubble both leave publicity rights for you to clear, so get written permission from any recognizable person on a product. One of Etsy's own examples of allowed AI art is a buyer's pet, painted by AI from the seller's prompt.
  • Your own copyright. The Copyright Office says images made purely by AI get no copyright, and prompts alone don't count as authorship. How to sell AI art on Etsy

You can sell AI-generated art on Etsy as one kind of item "designed by a seller". Etsy's Creativity Standards, last updated June 10, 2025, call it "seller-prompted AI creations". Etsy requires every item to carry a human touch, and for AI art it ties that to prompts you wrote yourself.

  1. Choose the format. A digital download of your design and a print made by a production partner both count as "designed by a seller".
  2. Write your own prompts. Etsy's category covers creations generated from a seller's original prompts or inputs, and its examples include a fantasy scene and a custom pet portrait.
  3. Check the file before you list it. Zoom in on hands, faces and any lettering, and make sure the pixel count supports the print sizes you offer: an 8 x 10 in print needs 2400 x 3000 px at 300 DPI.
  4. Say that AI was used in the listing description. Etsy requires this for every item created with AI.
  5. If a production partner prints and ships it, disclose that partner and say where the item ships from.
  6. Show the product the buyer receives, such as a photo of a printed sample or a mockup that matches it. This guide to Etsy mockups for digital products covers listing photos for downloads.
  7. Sell the art, not the recipe. Etsy doesn't allow AI prompt bundles.
  8. Keep brand names, characters and real people out of the image, the title and the tags.

Disclosure wording you can adapt

Keep the line short, specific and true to how you made the piece:

  • "This artwork was generated with AI from my own prompts, then color-corrected and retouched by hand."
  • "Made with AI: I wrote the prompts, chose the final image and edited the details. Printed and shipped by my print partner in the US."
  • "AI-generated digital download. You get one JPG at 2400 x 3000 px, which prints at 8 x 10 in at 300 DPI."

Only write "retouched by hand" or "edited" if you did that work yourself, and never describe AI art as hand-painted or hand-drawn.

Can I sell AI art on Redbubble?

Yes, under the same rules as any other upload. Redbubble's User Agreement, last updated May 15, 2026, doesn't mention AI. Redbubble says sellers can upload only their own original creations and need the rights holder's permission for anything they didn't make themselves. With each upload, you promise you hold every relevant right in the content, intellectual property and publicity rights included, and that it won't infringe anyone's copyright, trademark, privacy or publicity rights.

Redbubble doesn't prescreen uploads and handles infringement through takedown notices from rights holders, so the check is yours to do. Run each design through Google Lens, whose results include websites that show the same picture or a similar one, and drop any design that closely resembles an existing artwork.

Check the file size before you sell prints

Many AI images are too small for large prints. Gemini app downloads, for example, are 1K without a Google AI plan and 2K with one. Work out the largest print from the pixels before you list it. The printer 4OVER4 treats 300 DPI as the standard for prints viewed up close and 150 to 200 DPI for posters and banners seen from a few feet away. The formula is inches x 300 = pixels:

A file under these numbers can still print, but it will look soft at that size. Offer only the sizes your file supports, and list the pixel dimensions on digital downloads so buyers can check for themselves. Match the shape too: a 3:4 image fills 12 x 16 and 18 x 24 in frames, while an 8 x 10 in print is 4:5, so a 3:4 file loses about 2/3 in off its long side.

Make prints and listing photos in Toybox

Toybox AI's Terms of Service say you own the rights to the outputs you generate, subject to the Terms, and that how you use, share or sell them is your responsibility alone. Clear copyright, trademark and marketplace rules yourself before you list anything. Toybox doesn't currently add watermarks to AI results, so write the AI disclosure Etsy requires into each listing yourself.

  1. Create the artwork in Image Generator from a description you wrote. Choose Portrait 3:4 for posters or Square 1:1 for square prints. An image currently costs 50 credits.
  2. Download the PNG and compare its pixel dimensions with the print table. Toybox doesn't set a pixel size for Image Generator, so check every file.
  3. If the file is too small for the prints you want, choose "Open in Smart Editor" on the result. Smart Editor (Pro plan) can redraw it at 4K, currently for 110 credits: under "More options", set "Quality" to 4K and "Shape" to Social 4:5, then type an instruction such as "keep everything the same" into "What should change?". Social 4:5 at 4K comes back at 2560 x 3200 px, more than the 2400 x 3000 px an 8 x 10 in print needs at 300 DPI. Because it redraws the whole picture, compare faces, hands and edges with the original.
  4. Order one printed sample and photograph it on a plain background.
  5. Upload that photo to Product Mockup and pick a scene such as Studio ("Clean white background"), Workspace or Flat lay. It currently costs 75 credits per image.
  6. Compare the mockup with your print. Product Mockup places the exact item you photographed into the scene. It doesn't print a flat design onto a blank frame, mug or shirt, so photograph a real sample for each product.

Frequently asked questions

Do I have to tell Etsy buyers my art was made with AI?

Yes. Etsy's Creativity Standards say sellers must state in the listing description when an item was created with AI. Put the line near the top of the description, before sizes and shipping details, and keep it true to how you made the piece.

Can I sell AI art on Amazon?

For books, yes. Kindle Direct Publishing requires you to tell it about AI-generated images, including covers, interior images and artwork, when you publish or republish a book. Images you made yourself and only touched up with AI tools count as AI-assisted, which KDP doesn't require you to disclose. You're still responsible for respecting intellectual property rights.

Can I sell AI prompts on Etsy?

No. Etsy prohibits AI prompt bundles. Its policy treats the prompt as part of making the artwork, so you can sell the finished art you made from your prompts, as a digital download or a printed product, but not the prompts on their own.

Can I sell AI portraits of customers' pets or families?

Pets, yes. Etsy names AI-made portraits of buyers' pets as an allowed kind of creation. For people, get the permission of everyone in the photo, since Etsy prohibits content that infringes privacy or publicity rights. In Toybox, the Terms prohibit generating images of real people without their explicit consent.

What can I do if someone copies my AI art?

Report it to the marketplace, but know what you can claim. Redbubble takes Notice and Takedown Requests from people whose copyright or trademark rights are infringed, and a claim needs a right to stand on. The US Copyright Office says purely AI-made images aren't protected, so your strongest claim covers what you made yourself, such as your own drawing, hand edits or added text.
